Unsolicited Submissions Policy
Intellivision appreciates your enthusiasm and the time and energy you spend enjoying our games and offering suggestions and feedback. Intellivision company policy (“Policy”), however, does not allow Intellivision or any of its employees or contractors to accept or consider any unsolicited ideas, creative works, concepts or materials relating to any aspect of its business, including new or improved products, enhancements, game themes, processes, artwork, graphics, music, stories, characters, designs, inventions, names relating to any aspect of gaming, plans, marketing ideas or any other works, ideas, or intellectual property (collectively “Submissions”). This includes unsolicited Submissions from customers, fans, vendors, affiliates, partners, contractors, third parties, and other non-employees.
Please do not send or submit any such unsolicited Submissions in any form to Intellivision or any of its employees in violation of our Policy. The purpose of this notice is to avoid any disputes or misunderstandings should Intellivision develop or release any products or services that might seem similar to something you independently created or your Submissions in violation of our Policy.
If you violate the Policy by submitting any Submissions to Intellivision, by phone, electronic means, in person, mail or otherwise, then you hereby agree to the following regardless of any statements, conditions, or terms made by you to the contrary:
The Submissions, including any physical materials, are non-confidential and non-proprietary and will automatically become the property of Intellivision.
Intellivision shall have no obligations concerning the Submissions, including but not limited to, returning any physical materials, or acknowledging receipt of, reviewing, or communicating with you regarding any Submissions.
Intellivision may destroy or discard the Submissions.
Intellivision may use, copy, distribute, perform, display, publish, create any derivative works from or disclose the Submissions (including any ideas therein) for any purpose and in any way, commercial or otherwise, without any restriction, and without any compensation to you or any third party, and you hereby grant Intellivision an unrestricted, irrevocable, worldwide, non-exclusive, perpetual, fully sublicensable, transferable, royalty-free right and license under all worldwide intellectual property rights.
You represent and warrant that you own or have the authorization to sublicense all of the rights to the Submissions (including any ideas therein) and have full authority to disclose such Submissions to Intellivision, albeit in violation of our Policy, and will fully indemnify Intellivision if a third party alleges any violation of its rights due to the Submissions or any use thereof by Intellivision.
Intellivision shall not be liable for any use or disclosure of the Submissions.
You are not submitting the Submissions for sale to Intellivision, and Intellivision’s consideration or use of the Submissions is not conditioned on payment to you.
You have disclosed the Submissions to Intellivision at your sole discretion and in violation of Intellivision’s Policy as set forth above, and that Intellivision has not solicited the disclosure of the Submissions.
Intellivision has specifically reserved the right to implement similar ideas in the future without restriction or obligation.
Intellivision may modify this Policy at any time by updating this website. Otherwise, this Policy may not be modified or waived except in a written document signed by a duly-authorized Intellivision representative.
Feedback
While we do not accept or consider Submissions as set forth above in our Policy, Intellivision is always pleased to receive feedback regarding its existing products or other customer comments. Please only provide specific feedback on existing products, services, and information that is publicly disclosed, and do not include impermissible Submissions as set forth above in our Policy.
You agree that any feedback you provide as non-confidential and non-proprietary and that Intellivision shall be free to use such feedback on an unrestricted basis, without any compensation to you or any third party. You further agree to post feedback that is in keeping with and does not violate the terms and conditions detailed in Intellivision’s Privacy and Terms of Use policies.
